Judge Illston of the U.S. District Court for the Northern District of California on Tuesday granted Facebook’s motion to dismiss the Children’s Health Defense (CHD) lawsuit. COMPLAINT filed against Facebook, Mark Zuckerberg and the fact checkers in August 2020.
In a 45-page decision, the judge ruled that the CHD allegations – that Facebook was effectively a “state actor” in the name of the federal government and engaged in false advertising and racketeering – failed to articulate legal claims .
“While the decision is frustrating, we are not shock,” said Mary Holland, CHD president and general counsel. “Judge Illston’s line of questioning oral argument suggested he was inclined to judge in favor of Facebook’s motion to dismiss. Cases like this are challenging because they are novel; there have never been social media behemoths with such incredible power. Congress has clearly created an environment where they will face some legal hurdles, so it’s challenging to include them. ”
CHD is examining its legal options. The struggle to get real information to the public vaccines and 5G technologies, nothing censor and unrecognized “misinformation” or “disinformation,” will continue.
CHD is far from alone seeking more accountability from social media giants – Facebook could be heading for the fall. On Monday, the Federal Trade Commission case against Facebook on the antitrust ground was also dismissed. Pressure on Congress increased to update social media laws.
